User Agreement

Please read the user agreement (effective as of June 5, 2008) before using this service. By continuing to use NewOrleans.Com, you agree to abide by the conditions of this agreement.

SERVICE USER AGREEMENT

1. Welcome to NewOrleans.Com  ("Service"). By using this Service, you agree to be bound by all of the terms of this Agreement and by the Forum and Discussion Guidelines.  The Service is currently free to all users. NewOrleans.Com Media, L.L.C. reserves the right to charge for parts of this Service in the future. In  We reserve the right to change the terms of this Agreement or to modify any features of this Service at any time. By registering for this Service and/or continuing to use this Service after the posting of Notices regarding such changes, you agree to be bound by such changes.

2. You represent that you have read and agree to abide by the NewOrleans.Com Service User Agreement and the Forum and Discussion Guidelines.

3. This Service (including, but not limited to, text, photographs, graphics, video and audio content) is protected by copyright as a collective work or compilation under the copyright laws of the United States and other countries. All individual articles, content and other elements comprising this Service are also copyrighted works. You must abide by all additional copyright notices or restrictions contained in this Service. By posting content on the Service, a user is giving NewOrleans.Com Media, L.L.C. the right to display such content on the Service and its affiliated publications and to distribute such content and use such content for promotional and marketing purposes.

4. (a) Except for content you have posted on the Service, or unless expressly permitted, you may not copy, reproduce, distribute, publish, enter into a database, display, perform, modify, create derivative works, transmit, or in any way exploit any part of this Service, except that you may download material from this Service for your own personal use as follows: you may make one machine readable copy and/or one print copy that is limited to occasional articles of personal interest only. Without limiting the generality of the foregoing, you may not distribute any part of this Service over any network, including a local area network, nor sell or offer it for sale.
(b) NewOrleans.Com has been specially designed for presentation of content in a unique format and appearance to our users. We are concerned about the integrity of our Service when it is viewed in a setting created by a third party that includes advertising or other materials that we have not authorized to be displayed with our Service. Without limiting the provisions of (5a), neither you nor any third party shall make use of the contents of the Service in any manner that constitutes an infringement of our rights, including copyright or that has not been authorized by us.
(c) Just as NewOrleans.Com requires users to respect our copyrights, and those of our affiliates and partners, we respect the copyrights of others. If you believe in good faith that your copyrighted work has been reproduced on our site without authorization in a way that constitutes copyright infringement, you may notify our designated copyright agent either by mail to Copyright Agent, c/o Legal Department, NewOrleans.Com Media, L.L.C., 839 St. Charles Avenue, New Orleans, LA 70122.

5. You are also responsible for all statements made or materials posted under your name, including liability for harm caused by such statements or materials. You may not transfer, sell, or otherwise assign your rights or obligations under this Agreement.

6. You agree to indemnify and hold harmless NewOrleans.Com Media, L.L.C. and its affiliates, and their directors, officers, managers, employees, shareholders, agents, and licensors, from and against all losses, expenses, damages and costs, including reasonable attorneys' fees, resulting from any violation of this Agreement or the Forum and Discussion Guidelines.  We reserve the right to take over the exclusive defense of any claim for which we are entitled to indemnification under this Section. In such event, you shall provide us with such cooperation as is reasonably requested by us.

7. This Service is available "as is." We do not warrant that this Service will be uninterrupted or error-free. There may be delays, omissions, interruptions and inaccuracies in the news, information or other materials available through this Service. We are not responsible for the availability or content of other services that may be linked to this Service. We do not make any warranties, express or implied, including without limitation, those of merchantability and fitness for a particular purpose, with respect to this Service or any information or goods that are available or advertised or sold through this Service. We do not make any representations, nor do we endorse the accuracy, completeness, timeliness or reliability of any advice, opinion, statement or other material or database displayed, uploaded or distributed in this Service or available though links in this Service. We reserve the right to correct any errors or omissions in this Service. Although we intend to take reasonable steps to prevent the introduction of viruses, worms, "Trojan horses" or other destructive materials to this Service, we do not guarantee or warrant that this Service or materials that may be downloaded from this Service do not contain such destructive features. We are not liable for any damages or harm attributable to such features. If you rely on this Service and any materials available through this Service, you do so solely at your own risk.

8. NewOrleans.Com Media and its afilliates, and their directors, officers, managers, employees, shareholders, agents and licensors are not liable for incidental, indirect, consequential, special, punitive, or exemplary damages of any kind, including lost revenues or profits, loss of business or loss of data, in any way related to this Service or for any claim, loss or injury based on errors, omissions, interruptions or other inaccuracies in this Service (including without limitation as a result of breach of any warranty or other term of this Agreement). Any claim against us shall be limited to the amount you paid, if any, for use of this Service.

9. This Agreement may be terminated by either party for any reason at any time. Sections three (3) and six (6) through nine (9) of this Agreement shall survive such termination.

10. This Agreement shall be governed by the laws of the United States and the State of Louisiana.

Welcome to internet site of NewOrleans.Com Media LLC (otherwise referred to within as "we" or "our"): 
A.     Public Forums and Communication
1)    Our "forums" offer "optional" website opportunity created for our website users to initiate discussions and to "post" their information to our website.  Other references to this term include Web forums, message boards, discussion boards or bulletin boards.  The terms "forum" and "board" may refer to this website's complete community or to a specific sub-forum dealing with a specific category or topic. The information created can then be provided in chronological order or as threaded discussions for our website users to read.

2)    Netiquette refers to the guidelines that support online manners.  These online manners equate to our rules and regulations that must be adhered to participate in our forums for our specific website.  Tied to these rules is a Registration Agreement that must be accepted in order to post.

3)    Disruptive postings to our forum that will not be allowed are:
·    Trolling - multiple postings with intent to disrupt the postings or to bait others to respond

·    Crossposting - posting of the same content to several forums.

·    Spamming -  Users repeating the same word or phrase over and over

·    Use of Botnets - the posting of spam that has no real meaning or clear terminology

4)    Our message boards are governed by our set of rules.  Please review all of them. By posting on our message boards, you indicate that you accept our rules as part of this site's terms of service.

5)    Guidelines For Posting Messages:

·    Keep your posts concise.

·    Keep your replies on-topic.

·    If reading a message thread causes you to come up with an unrelated question, start another message thread.

·    Resist the temptation to hit the "Reply" button unless you've got something meaningful to add.

B.     FORUM Rules
We reserve the right to remove any post or user from our message boards at any time at our sole discretion.  When posts are deleted, it's usually because they violate one or more of our rules. Repeated violation of these rules may result in the suspension of your posting privileges.

OUR RULES FOR CONDUCT AND USE:

1.    Please choose your username carefully. You may not use names that are offensive, or suggest illegal activities that are meant to imitate others. Any such names will be blocked from posting on our message boards.

2.    Your chosen words should not include obscene, racist or sexually explicit language. No personal attacks will be permitted. We reserve the right to remove posts that are insulting to anyone or abusive, hateful, or defamatory.  We also reserve the right to remove posts that are off-topic or not in English.

3.    Harassment or threats of any kind will not be allowed. We take any threats, harassment very seriously. Posts that might be construed as such may be deleted and made available to the proper law enforcement officials.

4.    You may not suggest or encourage any form of illegal activity or is in violation of any International or United States Federal law.  This site will assist law enforcement officials in any investigation of such activities.

5.    No solicitations or advertisements are allowed which includes solicitations for your business, pyramid schemes or latest get-rich-quick business. This type of post clutters and devalues the message board.
A) Posting Messages That Promote Products: Almost all internet forums have policies that prohibit people from posting messages that promote their own products, and NewOrleans.com is no exception. The following types of product posts are allowed by bulletin board members:
·    If you are a satisfied (or dissatisfied) customer of a product/service, and you do not have a financial interest in the product/service, you may discuss it on the bulletin board. Positive and negative feedback from actual customers is one of the most helpful aspects of a bulletin board for those considering the purchase of a product/service.

·    Messages about sales, discounts, promotion codes, free product samples, etc. are fine, as long as you do not have a financial interest in the product, company, or promotion; and the offer is available to the general public.

B) Those that have a financial interest in a product or service may not post the following:
·    Information that promote your product/service.

·    Information that draws comparisons between your product/service and competing products/services.

·    Information that answer customer service questions or provide technical support for products.

·    Questions that inquire about customer satisfaction with products/services.

·    Information that discuss product/service development or improvement.

·    Information about sales, discounts, promotion codes, free product samples, etc. without prior approval by email from NewOrleans.com.

6.    You must own all material or have copyright ownership of all material that you post. No articles, recipes, song lyrics, art or graphics may be posted without the express written consent of the copyright holder.

7.    Privacy is important! No postings of any phone numbers, addresses, social security numbers or any other private information will be allowed.

8.    Online manners require that you don't post the same note more than once. We will not allow it.

9.    Any participation on our forum or message boards is at your own risk. You take responsibility for postings under your username and use the information provided here at your own risk. This website takes no responsibility for the content or opinions posted here.

10.    If you see a post that you feel violates any of the above rules, please notify this site's administrator: This e-mail address is being protected from spambots. You need JavaScript enabled to view it . We will respond in to all such notifications as quickly as possible..

11.    By posting to any portion of our site, you agree to abide by our rules.

12.    Please use good netiquette procedure, your common sense and enjoy the site and what it affords you.

C.    IDENTITY & REUSE OF CONTENT

We reserve the right to disclose your identity (whatever registration information we have from you including name, email address, IP address) in the event of a legal action or complaint arising from any message posted by you.

By posting content on this message board, you agree that NewOrleans.com can quote from, or reuse the content in promotional materials, newsletters, or other documents. If we intend to use content posted by you in such a manner, we will generally notify you as a courtesy.

D.    DISCLAIMERS OF LIABILITIES AND WARRANTIES:
It is impossible for the staff or the owners of this website and forums to confirm the validity of posts.  Please remember that we do not actively monitor the posted messages, and as such, are not responsible for the content contained within. We do not warrant the accuracy, completeness, availability, security, compatibility or usefulness of any information presented.

The posted messages express the views of the author, and not necessarily the views of this forum, its staff, its subsidiaries, or this forum's owners. You acknowledge that the staff and the owners of this forum reserve the right to remove objectionable content, within a reasonable time frame, if they determine that removal is necessary. This is a manual process, however, please realize that they may not be able to remove or edit particular messages immediately. This policy applies to member profile information as well.

The owners of this forum also reserve the right to reveal your identity (or any other related information collected on this service) in the event of a formal complaint or legal action arising from any situation caused by your use of this forum.  You remain solely responsible for the content of your posted messages. Furthermore, you agree to indemnify and hold harmless the owners of this forum.

You have the ability, as you register, to choose your username. We advise that you keep the name appropriate. With this user account you are about to register, you agree to never give your password out to another person except an administrator, for your protection and for validity reasons. You also agree to NEVER use another person's account for any reason.  We also HIGHLY recommend you use a complex and unique password for your account, to prevent account theft.

After you register and login to this forum, you will be able to fill out a detailed profile. It is your responsibility to present clean and accurate information. Any information the forum owner or staff determines to be inaccurate or vulgar in nature will be removed, with or without prior notice. Appropriate sanctions may be applicable.

Also note that the software places a cookie, a text file containing bits of information (such as your username and password) in your browser's cache.  Is in ONLY used to keep you logged in/out.  The software does not collect or send any other form of information to your computer.

F.     TERMINATION

NewOrleans.Com Media LLC reserves the right to terminate your use of and or access to this Site if it is decided that you have breached this Agreement or if you have engaged in conduct that is considered inappropriate or unacceptable. Note, that we also reserve to right, with each post your IP address will be recorded, in the event that you need to be banned from this forum or your ISP contacted. This will only happen in the event of a major violation of this agreement.

G.    REGISTRATION FORM 
Registering to use our forums or join our discussions constitutes an agreement to all the Terms and Conditions herein.
